TERMS OF SERVICE

The following Terms and Condition are between Sydney Premium Plumbing Pty Ltd (ABN 24 614 989 614) (“Sydney Premium Plumbing”) and the Customer acquiring the Services (“Agreement”). These Terms apply to any goods or services supplied or to be supplied to the Customer, or any third party on the Customer’s behalf. Any reference to Sydney Premium Plumbing includes all contractors or tradesman employed by Sydney Premium Plumbing to complete the Works. Any reference to the Customer also includes its respective successors or permitted assigns. If the Customer constitutes more than one person or entity, the Terms bind each of them jointly and severally.

Acceptance

Any instructions received by Sydney Premium Plumbing from the Customer for the supply of goods or services shall constitute acceptance of the Terms and Conditions contained herein.

Goods or Services to be Supplied

The goods or services to be supplied by Sydney Premium Plumbing will be described on a Work Agreement or a Quote or Invoice as supplied to the Customer in writing herein referred to as the “Works”. Any additional works required by the Customer which are not described on the Work Agreement or Quote or Invoice will be considered Variations and will incur further fees and charges.

Termination

In the event that the Customer wishes to terminate the Agreement prior to the completion of the Works, the Customer shall pay the for all goods or services purchased or provided up to the effective date of termination and any other reasonable costs incurred by Sydney Premium Plumbing.

Indemnity & Liability

The customer shall indemnify Sydney Premium Plumbing against any and all actions, claims, demands, suits, losses, costs, expenses and charges which Sydney Premium Plumbing may suffer or incur in connection with a claim by a third party, resulting from a breach of the customer’s obligations, undertakings and representations and warranties in connection with this contract or in relation to the words. To the fullest extent permitted by Law, the maximum liability of Sydney Premium Plumbing for all losses or damages from claims related in any way to the goods or services provided under this Agreement, shall be limited to the total amount paid by the Customer to Sydney Premium Plumbing under this Agreement.

Payment Terms

All invoices are due and payable on completion of the Works. Payment can be made by cash, debit card or credit card. For invoices not paid within seven (7) days, Sydney Premium Plumbing may charge interest equal to 10% on any outstanding amount. Interest will be calculated daily from the date payment was due until the date payment is made. All goods shall remain the property of Sydney Premium Plumbing until such time as payments are received in full.

Progress Payments

The Customer may be required to pay non-refundable progress payments upon commencement or during completion of the Works which will be deducted from the total quoted cost of the Works. Should the Customer fail to make any required progress payments, Sydney Premium Plumbing reserves the right to cease work until such time as the progress payment is made.

Variations

All quoted works may be subject to variations as required and are at the discretion of Sydney Premium Plumbing in order to carry out and complete works to Australian and Safety Standards. All variations will incur further fees & charges in addition to the original quoted amount.

Time Extensions

Sydney Premium Plumbing may estimate the completion date of the works. Sydney Premium Plumbing is not liable for any delays in completion of the work outside of their reasonable control.

Defects

The Client shall inspect the goods and Works on completion and must report any defects to parts or within 48 hours in writing to Sydney Premium Plumbing. Sydney Premium Plumbing must have the opportunity to inspect the alleged defects within 7 working days from date of written notification.

Insurance

Sydney Premium Plumbing Pty Ltd currently holds $20 million Public Liability Insurance. Our workers are covered by Worker’s Compensation Insurance.

Force Majeure

Sydney Premium Plumbing will have no liability to the Customer in relation to any loss, damage or expense caused by the Sydney Premium Plumbing’s failure to deliver the goods or complete the work as a result of fire, flood, tempest, earthquake, riot, civil disturbance, theft, crime, strike, lockout, breakdown, war, the inability of the Sydney Premium Plumbing’s normal suppliers to supply necessary material or any other matter beyond the Sydney Premium Plumbing’s control.

Removal of Waste and Materials

Sydney Premium Plumbing is not responsible for the removal of any waste materials. The customer is responsible for the removal of any/all waste materials resulting from the works carried out by Sydney Premium Plumbing.

Warranty

For goods provided by Sydney Premium Plumbing, the warranty shall be the current warranty provided by the manufacturer of the goods. Sydney Premium Plumbing warrants that the Works shall be carried out in a proper and workmanlike manner and the Works will be carried out in accordance with all relevant laws and legal requirements.
